For that one. I represent a bunch of trucking companies. 10 or more years ago, a bridge over a river in Chesapeake was found to have compromised piers due to the salt water effect on the rebar in the concrete. So the rating went from 60,000 lbs to 5,000. But the truckers used it to get in and out of one of the ports.
They changed the 12” x 6” sign to let truckers know but no other warnings. The penalties are based on weight. That doubles and triples as the violation goes up.
Client got a $35,000 ticket. Cops would set up scales on the port side so cargo going in had no idea. I show up in court with client and listen to a case ahead of ours and the ginormous, doughnut eating, pasty white cop tells the judge it is a safety issue. Judge reluctantly upholds the $30,000 fine against that poor unrepresented owner operator who now was facing bankruptcy and the loss of his livelihood. There were at least 25 truckers facing the same fate.
Our case was next. Porky Pig testified again. I asked him on cross examination if it was such a safety issue, then why not set up the scales on the other side of the bridge to stop drivers from the danger of crossing.
Before he could answer, the judge said, “I agree, case dismissed. And all of you truckers with cases here today are dismissed. And someone track down the driver I ruled against in the prior case and let him know I changed my mind and his case is dismissed too.”
Courtroom erupted.
It was a good day.
