Is the institution free to set its terms of matriculation?

Don't think it could base its terms on race. Or gender. Or age. Or religion. Or violate any other federal law.

Does this fit any of those categories? Eh, maybe religion, maybe others. I know there are carveout forms asking for exemptions, so maybe not.

But the "institution sets its own terms" isn't correct, and even less so for public than private.
