think the letter just needs to be forceful, not necessarily attorney-crafted (but the threat of an attorney lurking in the background is helpful).

I don't think what we're saying is all that different. The OP has a strong case as long as he's focused on the failure to disclose. If the seller and broker are smart, they'll make a pretty reasonable settlement offer, and the broker will kick in part of her commission. Otherwise, I think a sane small claims court judge (which could be asking a lot) would rule for the OP 99 times out of 100.
